Department Overview:
TD Legal is dedicated to providing industry-leading advice and counsel to all TD business segments and corporate functions. In this role as Senior Counsel, Litigation you will join a dynamic and collegial team of legal professionals who provide advice in respect of a range of litigation risks for Canadian Banking. The role is intended to be dynamic, with the successful candidate offering support to multiple business teams on a variety of issues within Canadian Banking. The role provides an opportunity to work in an exciting, important, and busy area, while gaining exposure to a range of stakeholders and leaders, both within TD Legal and across the enterprise.
Job Accountabilities:
This Senior Counsel role covers a diverse senior level litigation portfolio. Principal accountabilities include the areas of proactive and responsible litigation management, timely strategic and tactical advice, oversight and risk management, and sound practical guidance on processes. The candidate is expected to:
Manage external counsel in all aspects of litigation at all levels of court throughout Canada and to develop and implement strategy for the resolution of litigation.
Identifying key legal risks and mitigation strategies, while ensuring awareness among relevant stakeholders and other members of the TD Legal team.
Provide best in class litigation advice that is integrated with the strategies and objectives of the business and consistent with the enterprise-wide risk policy.
Provide regular oral and written reporting to senior members of the Canadian Banking Legal team, other members of the Legal Department, and other control groups, senior business executives and various Risk Committees.
Provide guidance and training to business and legal partners on best practices and developments in the law with a specialized focus on fraud law and discovery practice.
Provide senior counsel level advice in support of development and/or implementation of policies, procedures, and solutions that mitigate risk and enable the achievement of business/enterprise priorities.
As required, work closely with other control groups, such as Corporate Security, Compliance/Anti -Money Laundering and Risk.
Contribute to high priority special projects and other Legal Department initiatives.
Qualifications/Skills/Experience:
Law degree from an accredited law school and qualified to practice law in Ontario.
Possess 8+ years of post-call litigation experience working as a litigator
In-house litigation experience would be an asset
A solid background in banking, fraud and negligence litigation.
Experience litigating large, complex matters, including class actions and experience with Discovery/eDiscovery on large, complex matters.
Senior-level advanced ability to identify problems and barriers and effectively implement solutions to further business strategy.
Senior-level advanced ability to operate with creativity and innovation and a desire to seek different perspectives and new ideas.
Demonstrated excellence in judgment, leadership, and relationship management skills.
Strong analytical and problem-solving skills, as well as solid collaboration and teambuilding skills.
Flexibility to quickly adapt to changing and ambiguous initiatives or requirements.
Ability to multi-task is critical and to operate on a day-to-day basis with limited supervision is expected.
Strong technology aptitude including (i) proficiency with standard office software and ability to learn and apply new technologies in work environment and (ii) capacity to understand current and emerging technologies in the industry and how they affect business objectives.
